General
These Terms of Use govern your access to and the use of SoCalRentalNetwork.com and its related websites (defined herein as the “Site” or “Sites”). The Sites are operated by SoCalRentalNetwork, LLC, a California limited liability company (the “Company”). Any person or entity accessing or using the Sites is referred to herein as a “User” or “you.” The Sites, which are accessible by you without charge, are designed to allow you to view vacancies of apartments, single family homes and other rental properties.
Agreement and Acceptance of Terms of Use
As a condition to and in consideration for your use of and access to the Sites, you agree to accept and comply with the terms, conditions, and notices contained in these Terms of Use, as such Terms of Use may be modified from time-to-time by the Company without notice to you. These Terms of Use constitute a binding agreement between you and the Company. By accessing and using the Sites, you represent and warrant that you have the right, authority and capacity to enter into this agreement and abide by these Terms of Use. You acknowledge and agree that the Company reserves the right to alter, change, modify, or update these Terms of Use, which alterations, changes, modifications or updates may be made without notice to you. If the Company alters, changes, modifies or updates these Terms of Use, it will post such revised Terms of Use to the Site. You agree to review these Terms of Use regularly to be aware of any such revisions. Your continued access or use of the Sites after the Company makes any such alterations, changes, modifications or updates, shall be deemed acceptance of any such alterations, changes, modifications or updates. If any alteration, change, modification or update to these Terms of Use is unacceptable to you, you must discontinue your use and access of the Sites.
PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE ACCESSING OR USING THE SITES. IF YOU DO NOT WISH TO BE BOUND BY THESE TERMS OF USE, DO NOT ACCESS OR USE THE SITES.
You agree that the Company in its sole discretion may terminate your access to and use of the Sites at any time, with our without cause or notice. You acknowledge and agree that your permission to use and access the Sites shall be immediately terminated if you violate these Terms of Use.
Registration with the Sites
If you register for an account with the Sites, you agree to provide accurate and complete information requested by any forms. It is your responsibility to protect your password that you use to access any part of the Sites and you agree not to disclose such password to any third party. You agree to take sole responsibility for any activities or actions that are conducted using your account or password, whether such actions or activities have been authorized by you. Upon becoming aware of any unauthorized use of your account or password, you agree to notify the Company immediately at SoCalRentalNetwork@gmail.com.
Use of the Sites
You agree to access and use the Sites for you own personal and non-commercial uses. You agree to comply with all applicable laws, statutes, ordinances and regulations in accessing and using the Sites. In addition, you agree that you will access and use the Sites in accordance with these Terms of Use. In using and accessing the Sites, you agree that you will not:
· violate or infringe upon the rights of any third party, including but not limited to, copyright, trademark, or other intellectual property or proprietary rights;

{Cpost, transmit or otherwise make available any content that is unlawful, misleading, false, threatening, abusive, harassing, libelous, defamatory, harmful, vulgar, obscene, pornographic, profane, bigoted, or racist;
{Cencourage conduct that would violate any law or regulation, constitute a criminal offense or give rise to civil liability;
use or access the Sites in any manner that will damage, disable, overburden or impair the Sites or interfere with any third party’s use and enjoyment of the Sites;
{Cpost or transmit any materials or content that contains a virus or other harmful content designed to interrupt, destroy or limit the functionality of a computer software or hardware or telecommunications equipment;
{Cmpersonate any person or entity, or falsely state or misrepresent your affiliation or relationship with any person or entity; or
{C send unsolicited emails, junk mail, or spam, or advertisements or promotions.
The Company may monitor your access and use of the Sites in order to ensure your compliance with these Terms of Use.
Intellectual Property Rights
Content of the Sites
All right, title and interest to all content on the Sites, including, but not limited to, photographs, text, images, videos, messages, software, images, graphics, files, logos, trademarks, service marks, trade names and copyrighted material (“Content”), is either owned by the Company or by third parties with all rights reserved unless otherwise indicated. Such content is protected by copyright, trademark and other similar laws. The Company grants you a limited license to access and use the Sites and the Content solely for your personal, non-commercial use, including downloading or printing a copy of any part of the Content provided that your keep all copyright or other proprietary notices contain thereon. You agree that you will not modify, copy, distribute, reproduce, republish, download, display, post, prepare derivative works based upon, transmit, sell or otherwise use any of the Content, in whole or in part, except as expressly permitted in these Terms of Use or without the express written consent of the Company. You understand that the trademarks, service marks, trade names and logos that appear on the Sites are proprietary to the Company, its affiliates or its licensors and may not be used, reproduced, copied or displayed without the prior written consent of the Company. You acknowledge and agree that the Content is owned by the Company or other third parties and you do not acquire any rights in such Content by using or downloading such Content.
User Content
You are solely responsible for all Content that you upload, post, publish for display, submit or transmit (hereinafter, “Post”) on or through the Sites. You acknowledge and agree that the Company may review and remove any Posted Content that in its sole judgment violates these Terms of Use. You represent and warrant that you own the rights to the Content you Post on the Sites, including the rights to post such Content. By Posting Content to the Sites, you grant, and you represent and warrant that you have the right to grant, to the Company an irrevocable, perpetual, non-exclusive, fully paid, transferable, worldwide license (with the right to sublicense) to use, copy, perform, display, reformat, translate and distribute the Content and to prepare derivative works of, incorporate into other works, such Posted Content and to authorize sublicensees of the foregoing.

You acknowledge and agree that neither the Company nor its affiliates is responsible or liable for any content, goods or services available from such websites. Neither the Company nor any of its affiliates endorses or is responsible for the accuracy, completeness, quality or availability of any content, goods or services available on any such third party websites. Your use and access of such third party websites is at your own risk. Links to third party websites on the Sites do not imply any endorsement by the Company of such websites or the content or resources available thereon. Neither the Company nor any of its affiliates, officers, employees, members, or managers shall be liable, directly or indirectly, for any loss or damage caused to alleged to have been cause by your use and access of any third party websites linked to or from the Sites or your inability to access the Internet or any site linked to or from the Sites.

Upon providing prior written notice to the Company at SoCalRentalNetwork@gmail.com, you may create a link to the website www.SoCalRentalNetwork.com. By creating a link to the Site, you represent and agree that you own or control the site on which you create the link and such site, and all other websites to which such site links, comply with all applicable laws and do not abuse, defame, threaten, harass or violate the privacy, intellectual property or other rights of a third party. You agree that you will not in any manner access, collect, store, disclose, transfer or use any information obtained or derived from a user's access to or use of the Sites. The Company may revoke its consent to the link at any time in its sole discretion and you agree to remove and stop using the link immediately at any time that the Company so requests. All of the Company’s rights and remedies are expressly reserved.
Compliance with Fair Housing Laws.
All Content, including third party Content, is subject to federal and California fair housing laws, which make it illegal to indicate in any advertisement any preference, limitation, or discrimination because of race, color, religion, sex, physical or mental disability, and/or familial status, sexual orientation, ancestry, marital status or source of income. Your local state jurisdiction may also prohibit any preferences based on other criteria. THE COMPANY EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT AND NON-INFRINGEMENT. THE COMPANY MAKES NO WARRANTY THAT THE SITES WILL BE AVAILABLE ON AN UNINTERRUPTED, SECURE OR ERROR-FREE BASIS.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE DAMAGES OR ANY DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO LOST PROFITS, ARISING OUT OF OR RESULTING FROM ANY CONTENT OR SOFTWARE AVAILABLE OR OBTAINED THROUGH USE OF THE SITES, YOUR ACCESS TO OR USE OF THE SITES OR YOUR INABILITY TO ACCESS THE SITES, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. ALL USE OF THE SITES IS DONE AT YOUR OWN RISK AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE OR HARM TO YOUR COMPUTER SYSTEM, LOSS OF DATA OR OTHER HARM THAT RESULTS FROM YOUR USE OF OR ACCESS TO THE SITE.
YOU ACKNOWLEDGE AND AGREE THAT THE COMPANY IS NOT LIABLE FOR ANY DEFAMATORY, OFFENSIVE, FRAUDULENT OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES. IF YOU ARE DISSATISFIED WITH ANY CONTENT ON THE SITES, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE YOUR USE OF THE SITES.

Indemnification
You agree to defend, hold harmless, and indemnify the Company, its affiliates, officers, members, managers, employees, and agents from and against all claims, liabilities, damages, losses and expenses, including but not limited to, reasonable attorneys’ fees, due to or arising out of, or in any way connected with your use of the Sites or violation of these Terms of Use by you or any of your affiliates, or any Content submitted, posted or otherwise provided on or through the Sites.
Applicable Law
This agreement and these Terms of Use are governed by the laws of the state of California, without regard to conflicts of law principals. You hereby consent to the exclusive jurisdiction and venue of the state and federal courts sitting in Los Angeles County, California and waive all defenses of lack of personal jurisdiction and forum non conveniens in all disputes arising out of or relating to these Terms of Use or access or use of the Sites.
Severability
Should any part of these Terms of Use be held invalid or unenforceable, the remaining parts of these Terms of Use will remain in full force and effect. The Company’s failure to enforce any right or provision of these Terms of Use will not be deemed a waiver of such right or provision.
Entire Agreement
These Terms of Use constitute the entire agreement between you and the Company, and supersedes any prior or contemporaneous agreements with respect to the subject matter herein.
Non-Assignment
This agreement is personal to you and you may not assign your rights or obligations hereunder to anyone.
